Charmants.com's proprietary rights (as per Section IV of our Terms of Service)

By submitting, posting or displaying any Materials on Charmants.com, you automatically grant to us a worldwide, non-exclusive, sublicenseable, transferable, royalty-free, perpetual, irrevocable right to copy, distribute, create derivative works of, publicly perform and display such Materials. To clarify, the above does not apply to Materials on external sites linked to by the original submission. Our use of your personal information is governed by our Privacy Policy. The service also contains graphics, text, photographs, images, video, audio, software, code, and other material that is provided by Charmants.com or its licensors and is not clearly identified as, or intended, for your use, including without limitation the organization, design, compilation, and "look and feel" of the service, and advertising thereon ("Service Content"). The Service Content is protected by the Canadian Intellectual Property Office (CIPO) and international copyright, trademark and other intellectual property laws, and is the property of Charmants.com or its licensors. The copying, reproduction, publication, display, rearrangement, redistribution, modification, revision, alteration, cropping, re-sizing, reverse engineering, movement, removal, deletion, or other use or change by you, directly or indirectly, of any such Service Content, including but not limited to the removal or alteration of advertising, is strictly prohibited. CHARMANTS.COM is a registered trademark.

Copyright complaints (as per Section X of our Terms of Service)

Charmants.com is an information location tool that helps you find content legally posted by others on the Internet. It is our policy to respond expeditiously to claims of copyright and other intellectual property infringement. Charmants.com will promptly process and investigate notices of alleged infringement and will take appropriate actions under the Canadian Copyright Act (CCA) and other applicable intellectual property laws. Upon receipt of notices complying or substantially complying with the CCA, Charmants.com may act expeditiously to remove or disable access to any reference or link to material or activity that is claimed to be infringing. Charmants.com will terminate access for Registered Users who are repeat infringers.

If you believe that Charmants.com contains links or other references to another online location that contains material or activity that infringes your copyright rights, you may send a written communication through the Contact page. To be effective, a notification of claimed infringement must include the following:

i. Signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;

ii. Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;

iii. Identification of the material to which access is to be disabled, and information reasonably sufficient to permit us to locate all references and outbound links to the material;

iv. Information reasonably sufficient to permit Charmants.com to contact the complaining party, such as an address, telephone number, and if available, an electronic mail address at which the complaining party may be contacted;

v. A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the law;

vi. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please note that you may be liable for damages -- including costs and attorneys' fees -- if you materially misrepresent that an activity is infringing your copyright. If you are uncertain whether an activity constitutes infringement, we strongly recommend that you seek the advice of an attorney.
